Hyeonalytics Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the Hyeonalytics website and any content, features, or services made available through it (collectively, the "Service"). The Service is operated by Hyeonalytics, based in Seoul, Republic of Korea ("Hyeonalytics", "we", "our", or "us").

1. Acceptance of Terms

By accessing or using the Service in any manner, including by browsing the website, you confirm that you have read, understood, and agree to be bound by these Terms and all additional policies referenced in them. If you do not agree to these Terms, you must not access or use the Service.

You may use the Service only if you are capable of forming a binding contract with Hyeonalytics and are not barred from using the Service under applicable law. If you are using the Service on behalf of a company or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms, in which case "you" and "your" will refer to that entity.

2. Description of Service

Hyeonalytics provides informational content and resources related to data analysis, analytics methodologies, tools, and best practices. The Service may include articles, reports, tutorials, case studies, visualizations, and other materials intended for educational and informational purposes only.

The Service does not provide personalized professional, financial, legal, or business advice. Any decisions you make based on information obtained from the Service are made at your own discretion and risk. We may update, modify, or discontinue any aspect of the Service at any time, with or without notice.

3. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for all of your activity in connection with the Service.

3.1 Permitted Use

Subject to your compliance with these Terms, you may access and use the Service solely for your own personal, non-commercial, informational, and educational purposes. You may download or print a reasonable number of pages from the Service for your personal use, provided that you do not remove any copyright or other proprietary notices.

3.2 Prohibited Conduct

You must not, and must not enable or permit any third party to, directly or indirectly:

• Access or use the Service in any manner that violates any applicable law or regulation in the Republic of Korea or any other jurisdiction that applies to you.
• Attempt to gain unauthorized access to any portion of the Service, other user accounts, computer systems, or networks connected to the Service, whether through hacking, password mining, or any other means.
• Probe, scan, or test the vulnerability of any system or network related to the Service or breach, or attempt to breach, any security or authentication measures.
• Interfere with or disrupt the operation of the Service or the servers or networks used to make the Service available, including by introducing any viruses, malware, worms, Trojan horses, or other harmful code.
• Use the Service to send, upload, or distribute any unsolicited or unauthorized advertising, promotional materials, spam, junk mail, chain letters, or any other form of solicitation.
• Use any robot, spider, scraper, crawler, or other automated means or interface not provided by us to access the Service or to extract data, except as permitted by applicable law and, where relevant, by a written agreement with Hyeonalytics.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any part of the Service, except to the limited extent that applicable law expressly permits such activity.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity, including Hyeonalytics or its representatives.
• Use the Service to upload, publish, or transmit any content that is unlawful, harmful, fraudulent, deceptive, defamatory, obscene, hateful, discriminatory, or otherwise objectionable.
• Use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service.
• Use or attempt to use any content on the Service for commercial purposes without our prior written consent.

We reserve the right, but do not have the obligation, to monitor access to or use of the Service and to investigate or take appropriate legal action against any conduct that we reasonably believe violates these Terms or is otherwise harmful.

4. Intellectual Property

Unless otherwise indicated, all content and materials on the Service, including text, graphics, diagrams, data visualizations, logos, icons, images, and the design and arrangement thereof, are owned by or licensed to Hyeonalytics and are protected by copyright, trademark, and other intellectual property laws in the Republic of Korea and internationally.

Subject to your compliance with these Terms, Hyeonalytics grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service and to view the content solely for your personal, non-commercial, informational purposes.

Except for the limited license expressly granted above, no rights, title, or interest in or to the Service or any content are transferred to you. You must not reproduce, distribute, publicly display, publicly perform, modify, create derivative works of, or otherwise exploit any content obtained through the Service without our prior written consent or the consent of the applicable rights holder.

5. Disclaimer of Warranties

The Service and all content provided through it are made available on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory.

To the fullest extent permitted by applicable law, Hyeonalytics expressly disclaims all warranties, express or implied, including any implied warranties of accuracy, reliability, merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

Without limiting the foregoing, Hyeonalytics does not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, that the Service or the servers that make it available are free of viruses or other harmful components, or that the information obtained through the Service will be current, complete, or reliable.

Any use of the Service and reliance on any content is at your sole risk. You are responsible for verifying any information before acting on it and for implementing appropriate safeguards to protect your systems and data.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Hyeonalytics and its directors, officers, employees, contractors, and agents will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or in connection with your access to or use of, or inability to access or use, the Service, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, Hyeonalytics' total aggregate liability for any claim arising out of or relating to these Terms or the Service will be limited to the greater of (a) the amount you have paid to Hyeonalytics for use of the Service in the six (6) months preceding the event giving rise to the claim, if any, and (b) KRW 100,000.

Some jurisdictions do not allow the exclusion or limitation of certain damages or liabilities. In such jurisdictions, the exclusions and limitations above will apply only to the extent permitted by applicable law.

7. User-Submitted Content

From time to time, the Service may allow you to submit, post, or share comments, feedback, suggestions, or other content ("User Content"). You retain ownership of any intellectual property rights that you hold in your User Content.

By submitting User Content through the Service, you grant Hyeonalytics a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and perform such User Content in connection with operating, improving, and promoting the Service. To the extent permitted by law, you also waive any moral rights you may have in the User Content.

You represent and warrant that you have all rights necessary to grant the above license, and that your User Content and our use of it in accordance with these Terms will not infringe, misappropriate, or violate the rights of any third party or violate any applicable law.

We may, but are not obligated to, monitor, review, or edit User Content and may remove or disable access to any User Content at our sole discretion, including where we believe it violates these Terms or is otherwise objectionable.

8. Links to Third-Party Sites

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by Hyeonalytics. These links are provided solely for your convenience and do not constitute an endorsement, sponsorship, or recommendation by Hyeonalytics of the third-party sites or their content.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You access and use any third-party sites at your own risk and subject to the terms and policies of those sites.

9. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to them or the Service will be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service that cannot be resolved amicably will be subject to the exclusive jurisdiction of the competent courts of Seoul, Republic of Korea, to the extent permitted by applicable law.

10. Modifications to Terms

We may revise these Terms from time to time. When we do, we will update the "Effective date" at the top of this page. Any changes will become effective when we post the revised Terms on the Service, unless otherwise stated.

Your continued access to or use of the Service after the revised Terms have become effective will constitute your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

11. Termination

We may suspend or terminate your access to all or part of the Service at any time, with or without notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal activity, or for any other reason at our sole discretion.

Upon termination for any reason, all rights and licenses granted to you under these Terms will immediately cease, and you must discontinue all access to and use of the Service. Any provisions of these Terms that by their nature should survive termination (including, without limitation, provisions relating to intellectual property, disclaimers, limitations of liability, and governing law) will continue in effect.
